In September 2006, OrthoClear chose to go out of business rather than defend its position in court after nearly two years of numerous lawsuits with Align Technology. OrthoClear abruptly stopped treatment of existing patients and stopped accepting new patient cases. Align did not acquire OrthoClear or take over any OrthoClear cases. The final legal settlement between OrthoClear and Align did not involve acquisition or the transfer of cases, sales forces, production facilities or operations. As part of the settlement, Align voluntarily offered to provide free Invisalign treatment for approximately 30,000 former OrthoClear patients |
